BY ACCESSING THE SITE AND/OR USING THE SERVICES, YOU CONFIRM AND ACKNOWLEDGE (1) THAT YOU HAVE READ THIS AGREEMENT, (2) THAT YOU UNDERSTAND ITS CONTENT, AND (3) THAT YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS CONTAINED IN THIS AGREEMENT, INCLUDING ANY ANCILLARY TERMS LIKE OUR PRIVACY POLICY.

The compilation (meaning the collection, arrangement, and assembly) of all content on the Washworldinc.com website is the exclusive property of Washworld, Inc. WASHWORLD DOES NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY INFORMATION OBTAINED THROUGH THE SITE WILL BE ACCURATE, COMPLETE, OR RELIABLE. 5.2 Limitation of Liability. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WASHWORLD OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE OR SERVICES, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL COMPANY'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR SERVICES EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS PAID BY YOU TO WASHWORLD, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
5.3 Exceptions. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for incidental or consequential damages, so the limitations in Sections 5.1 and 5.2 may not apply to you in whole or in part. Nothing in these Terms is intended to exclude or limit liability that cannot be excluded or limited under applicable law, including, where applicable, liability for gross negligence, willful misconduct, fraud, or bodily injury caused by Washworld's negligence.
5.4 Indemnification. You agree to defend, indemnify, and hold harmless Washworld and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of or access to the Site or Services, (b) your violation of these Terms, (c) your violation of any third-party right, including without limitation any intellectual property, privacy, or publicity right, or (d) any content you submit, post, or transmit through the Site. Washworld reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate with Washworld's defense of such claim.
5.5 Governing Law and Venue. These Terms and any dispute arising out of or relating to these Terms or your use of the Site or Services shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of laws principles. The exclusive jurisdiction and venue for any action arising out of or relating to these Terms shall be the state and federal courts located in Brown County, Wisconsin, and you consent to the personal jurisdiction of such courts.
5.6 Force Majeure.
Washworld shall not be liable for any failure or delay in performance under these Terms resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, supply chain disruptions, internet or utility outages, or pandemic or public health emergency.
6. Third Party Copyright
If you believe that your copyright has been infringed by the content of the Washworld website or any website linked to which a link is provided on Washworldinc.com, then please notify Us immediately (Marketing on Contact Us). All third party content was used following strict guidelines set forth by the FTC on comparative advertising claims and the National Advertising Division of the Better Business Bureau, to provide truthfulness and accuracy to consumers.
7. Washworld Trademarks
The graphics, logos, service names and trademarks used on the site are the property of Washworld, Inc., its content suppliers and the suppliers of third party goods and services offered on the site. The trademarks may not be used in connection with any product or service that is not the trademark owners', in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits the trademark owner. Use of the "Washworld" name, logo, or other Washworld trademarks is restricted and requires Washworld's express written permission. 8. Minors
The Site and Services are not directed to children under the age of 13, and Washworld does not knowingly collect personal information from children under 13. If you are under 13, please do not use the Site or submit any personal information to Us through the Site.
If a parent or legal guardian believes that a child under 13 has provided personal information to Washworld, please contact Us at marketing@washworldinc.com, and We will take reasonable steps to delete such information from Our records.
Use of the Site by minors between the ages of 13 and 18 (or the age of majority in their jurisdiction) requires the consent of a parent or legal guardian.
